GENERAL TERMS & CONDITIONS FOR WILD WINDS
Bookings Conditions Wild Winds
a. In these booking conditions references to the ‘Owner’, ‘we’, ’us’ and ‘our’ means Andrea Vaughan of Nyth yr Aderyn Penywaun Pentyrch CF159SJ. References to ‘you’ and ‘your’ include the first named person on the booking and all persons on whose behalf the booking is made and who are named on the booking. The booking is non transferable.
b. We endeavour to ensure the accuracy of all the information and prices in our advertising material. However, occasionally change and errors do arise and we reserve the right to correct them in such circumstances. You must check the current price and other information relating to the holiday you wish to book before your booking is confirmed. We will not be liable for booking errors which are attributable to you or which are caused by unavoidable and extraordinary circumstances as defined in clause 5.
c. Wild Winds is our home. It is furnished with items of great sentiment. It is our home from home when we visit family and friends in the village. We are lucky that they keep watch over Wild Winds in our absence. Wild Winds is best suited to family usage and is not suitable for stag and hen parties. Please enjoy the facilities and treat Wild Winds with care and respect
1.Our agreement
Please ensure you read and fully understand these booking terms and conditions as they form the contract between us. They set out our respective rights and obligations. These conditions together with any other written information we brought to your attention form the basis of your contact with us. By making a booking you agree to be bound by all of them.
Our agreement becomes a binding contract when we issue a confirmation. Please check all details on the confirmation (or any other document issued) immediately upon receipt. It may not be possible to make changes to your holiday booking late so you should notify us of any inaccuracies in any documentation within seven days of the same having been sent out. It may harm your rights if you don’t do so.
2. Payment
- All deposits are non refundable. If we do not receive any payment due in full and on time, we reserve the right to treat your holiday booking as cancelled by you in which case you will be liable to pay the balance due on your holiday booking.
- A non-refundable 25% deposit of the holiday cost is payable at the time of booking. Bookings made less than eight weeks before your arrival date must be paid in full, plus the £100 Good Housekeeping Bond (for those guests bringing a pet as referred to in clause 7).
- The balance of your payment must be paid no later than eight weeks before the commencement of your holiday. If the balance is not received by the due date, then your holiday will be treated as a cancellation by you and you will remain liable to pay the balance due on your holiday booking
- All cancellations must be notified in writing. If you cancel your holiday more than eight weeks before it is due to start, then your deposit will be forfeit. If you cancel less than eight weeks before the holiday, then the full balance remains due and is not refundable.
- It is a condition of this agreement that you are covered by adequate travel insurance that you take out comprehensive travel insurance to cover your holiday booking. Such insurance as a minimum must cover your losses sustained as a result of cancellation medical issues and repatriation in the event of accident or illness. Your travel insurance should also cover against COVID 19 issues or incidents which may affect your holiday booking. If you choose to travel without adequate insurance cover, then we will not be liable for any of your losses howsoever arising in respect of which insurance cover would otherwise have been available
3. Disabilities and medical issues
- You acknowledge that you are choosing to book holiday accommodation air a time when you may be exposed to the COVID19 virus.
- You also acknowledge that you must comply with all advice and guidance issued by relevant governments and health authorities. It is your own responsibility to acquaint yourself with all relevant information, including applicable health risk. We both agree that you are making your booking in full knowledge that such measures are likely to be part of your activity on holiday and do not amount to significant change to your holiday booking.
- If you or a member of your party has any precise medical problem or disability which may affect your holiday booking, please provide us with full details before making your booking and, if possible, before a confirmation is issued. Wild Winds Accessibility Guide is available to read prior to booking. Please contact the owner to discuss the suitability of Wild Winds for your specific needs.
4. Changes or cancellations by us
The Owner reserves the right to refuse any booking and to cancel any bookings already made if the property is unavailable (eg through fire, flood, etc) for any reason whatsoever, subject to a full refund of all monies paid (but no further liability). The Owner shall be under no other liability if such cancellation occurs.
5. Unavoidable and extraordinary circumstances
Except where otherwise expressly stated in these booking conditions we will not be liable to pay you a price reduction or compensation if our contract obligations to you are affected by unavoidable and extraordinary circumstances beyond our control which we could not avoid even if all reasonable measures had been taken. These events can include, but are not limited to war, threat of war, civil strife, terrorist activity and its consequences or the threat of such activity, riot, pandemic, or the continuing effects thereof, the act of any government or other national or local authority, industrial dispute, natural or nuclear disaster, fire, chemical or biological disaster, adverse weather conditions and all similar event outside our control.
6. Your obligations
You agree to each of the following:-
- Not to hold parties or events at Wild Winds or in its grounds
- Not to re-let, sublet or share the property in any circumstances, even free of charge, except with those persons named on the booking.
- Not to exceed the maximum number of guests using the accommodation at any time and to permit only those named on the booking, to occupy the property. The maximum number is 5 persons where 3 bedrooms are booked as the standard letting. Where guests have booked the optional extra 4th bedroom, the maximum number is 7 persons. We reserve the right to terminate the booking without notice and without refund in case of a breach of this condition.
- To inspect Wild Winds and in particular its grounds immediately upon your arrival and note possible hazards. The garden has a number of steep drops, some wooden steps, a small pond and is generally uneven underfoot. Young children and those with physical restrictions will need to be supervised and made aware of the hazards.
- To permit the Owner and their representatives to enter the accommodation and grounds at Wild Winds at any time to undertake essential maintenance or for inspection purposes.
- To vacate the Wild Winds by 9.30 on the day of departure. This allows the accommodation to be thoroughly cleaned and prepared for incoming guests. Because of Covid it is not possible to drop off luggage before 5.00 pm on arrival date or to collect luggage after 9.30 on departure date while cleaners are at the property.
- Not to engage in or permit vaping or smoking or allow pets anywhere inside Wild Winds or its grounds failure to do so will result in immediate termination of occupancy and forfeiture of all payments. This must be strictly adhered to and any damage or extra cleaning caused by pets or smoking will be at your additional expense.
- To take all reasonable and proper care of Wild Winds, its garden furniture, summerhouse, beach shed and its grounds and leave the same in a clean and tidy condition at the end of your holiday. You agree to be responsible for any additional cleaning costs should you fail to do so.
- To inform the Owner by text or email of any problems with the facilities or services at Wild Winds
- To advise the Owner by text or email immediately upon any breakages damages or losses being caused by you. Damages and breakages – please treat the facilities & accommodation with due care so that other guests may continue to enjoy them. If you notice something is missing or damaged in your accommodation, please let me know immediately so that I can take the appropriate action. If there has been any damage or breakages during your stay, please contact me immediately by text or by email so that I have the maximum amount of time to take remedial action before the next guests arrive. The accommodation will be inspected at the end of the holiday & you may be charged for any loss or damage.
- To pay for any breakages, losses or damages caused by you to Wild Winds or its facilities.
- Not to move any furniture from one room to another. If you move garden furniture from one part of the garden to another, please return it to original position before you leave. Please take care to bring garden cushions in at the end of each day.
- To lock the doors and close the windows when you leave the property unoccupied.
- To switch off lights and any electrical appliances when you go out – aiming to be an eco-friendly holiday home.
- Not to take any bath towels with you to the beach.
- Not to remove the Information Pack which is kept at the property for guests’ use. It includes info on the recycling and refuse scheme, medical and emergency contact numbers, details of local attractions and places to dine etc. I do like to know what our guests have enjoyed and discovered to share with other guests. Some of the local dining options are very popular and advance booking in peak seasons is advisable. Covid has seen increased need to book ahead. Some info on dining options is available on @wildwindslittlehaven Instagram account. Please do feel free to ring or email for info too.
- To return all keys at the end of your stay; if any keys issued are not returned at the end of your stay, then the cost of replacement / changing the door barrel will be charged to you.
- To leave all Inventory in the property.
- Guests are responsible for the safety and security of their children in their care at all times. There is a small pond in the grounds and some steep banks. Never leave children without adult supervision.
- To park your vehicles in the designated parking space, ensuring cars do not block access to other properties, in particular the gate affording access to The Sheepfields. Parking is limited to 3 vehicles and one boat trailer.
- Please respect the community and try to keep noise levels to a minimum, especially between 11 pm and 8 am.
- We reserve the right to terminate a holiday without compensation where the unreasonable behaviour of persons named on the booking (or their guests) may impair the enjoyment, comfort or health of others.
- Not to light fires or barbecues near the house or near the oil storage tank in the gravelled parking area. Please use the designated barbecue utensils and clean the barbecue after use. Please use disposable BBQ trays on the concrete BBQ. Please dispose of BBQ coals in the metal bin provided in the blue shed at the bottom of drive next to main gate.
- Not to use candles inside the house.
- Not to do or omit to do something which may become a nuisance to neighbouring properties.
- To follow the Checkout Checklist which is set out in the Information Pack emailed to you after your booking is confirmed. Check-out is at 9.30 am, a checkout reminders leaflet is in Info Pack kept at the property. The Checklist includes reminders to ensure no personal items left in drawers, wardrobes and washing machine (you’d be surprised at how many valuables get left behind!) etc, to sort and dispose of refuse and leave the dishwasher empty.
7. PETS
We only allow one small well behaved and trained dog, to be agreed with us PRIOR to accepting the booking, no other kinds of pets. In order to maintain Wild Winds for everyone to enjoy, it is necessary that guests bringing a dog agree to these conditions.
Additional Terms and Conditions for guests bringing their dog.
a) You must obey the Countryside Code and keep your dog(s) under close control at all times for their own safety as well as for the benefit of other dog owners and livestock.
b) Poop patrol! When taking your dog(s) for a walk, please pick up after them including in the gardens at Wild Winds. Failure to clean up after your dog will be heavily surcharged.
c) When you bring a muddy dog back from a walk, please clean them off using the outside tap and your own canine towels. On no account use the white towels provided for human use.
d)Your dog must not be left alone at or in Wild Winds at any time. They may chew the furniture or soft furnishings here in our 5-star cottage! Maintaining our grading is key to our business and we can’t always repair things, it has to be replaced, at your expense. The garden is NOT fully enclosed so please be careful.
e) Dogs are not allowed in the bedrooms or in any carpeted room and are not allowed on any sofas or beds. The open-plan kitchen dining and family lounge and utility room entrance has tiled flooring throughout.
f) Please thoroughly clean the cottage, including dog hair from rugs, before you leave; if properties require additional cleaning or dogs have been in the Grown Ups lounge, bedrooms, or on an uncovered sofa, we will charge a £50 fee to cover the cost.
g) to pay a £100 Good Housekeeping Bond
h) to pay £30 per week or part thereof for the dog to be added to guest list. Only the type of dog agreed and named on booking confirmation will be allowed
i) your dog must use its own bedding, towels and food trays and bowls which you will take to Wild Winds.
8. Complaint
Any problem or complaint which you may have about your holiday should be immediately reported to the Owner by text 07760 925002 or send an email and the Owner will endeavour to put matters right. Any complaints not reported to the Owner at the time and only reported after you have returned from holiday may affect our ability to investigate your complaint and could affect your rights under our agreement. I really appreciate the opportunity to put things right and for you to enjoy your time at Wild Winds.
9. Our responsibility and liability
- We make every reasonable effort to indicate safety hazards in our property description. It is however your responsibility (particularly parents and anyone with physical restrictions) to inspect the property and grounds immediately upon arrival and note possible hazards. Wild Winds is located in the countryside which can hold its own hazards such as barbed wire in fencing, electric fencing and animals in fields. Please note that regular country smells and noise will not be classed as a cause of complaint.
- We will use reasonable skill and care in providing accommodation under this contract. You must prove that we have breached that duty and damage to you has been caused, in order to make a claim against us.
- We cannot accept responsibility for any material loss, damage, additional expense or inconvenience directly or indirectly caused by or arising out of the property, its plumbing, gas, electrical services or exceptional weather.
- No responsibility is accepted for loss or damage of personal belongings and valuables, vehicles or vehicle contents belonging to you or members of your party during your occupancy of Wild Winds.
- The maximum liability accepted by the Owner will be the total cost of the holiday as paid by you to us. No other expenses such as travelling costs or alternative accommodation will be accepted.
- The Owner shall not be liable for any temporary defect or malfunction of any equipment, broadband, machinery or appliance in the buildings and grounds.
- No compensation will be given for any temporary outage of electricity, gas, water, internet connection or television service.
- The Owner is not responsible for the loss of any personal belongings or valuables belonging to you or members of your party.
10. Jurisdiction and Applicable Law
This contracted all matters arising out of it are governed by English law. We both agree that any dispute, claim or other matter which arises out of or in connection with this contract will be dealt with by the courts of England and Wales only.
